TVGfree.net Contest Rules
These contest rules are to be read in conjunction with and are governed by the Terms of Use and Privacy Policy of the TVGfree.net website (“TVGfree.net” or the "Site") which is owned and operated by ODS Technologies, L.P. (“TVGfree”). These Contest Rules set out the legally binding terms for your participation in the contest offered on TVGfree.net. TVGfree may modify these Contest Rules from time to time and such modifications shall be effective upon posting by TVGfree on the Site. You agree to be bound by any changes to these Contest Rules when you enter a new contest after any such modification is posted. Your participation in the contest is conditioned upon your acceptance of these Contest Rules. The contest may be subject to additional terms which are posted on the Site in connection with the contest, and are incorporated by reference into these Contest Rules. In the event of any inconsistency between these Contest Rules and additional posted conditions, the provisions of the additional posted conditions shall control.
TVGfree reserves the right, in its sole discretion, to suspend, or terminate your participation in the contest at any time, for any or no reason, with or without prior notice, and without liability.
1. One contest will be offered each day of the year (except Christmas)
2. Each user can only enter each contest once. Each user may participate in a new contest every day.
3. In order to participate in the contest, users must click on “Enter Contest” and provide the following required information: handle name, online contact information (email address), zip code, birth month and year. The daily winner’s handle name will be posted on the “Past Contest Winners” page. Please note that in accordance with our Terms of Use, if you choose a handle name that, in TVGfree's sole discretion, is inappropriate, we reserve the right, without prior notice to you, to automatically change your handle name, deny you access to the Site and/or terminate your participation in the contest. You agree to provide only true, complete and current information.
4. Contests will remain open for a specified amount of time during the day (usually 4 hours).
5. Users making any play type (win, place, show, exacta, etc) on any track offered on TVGfree.net are eligible as contestants.
7. Users will not be given additional TVG Dollars to play in the contest. Users may only use the TVG Dollars currently in their account. TVG Dollars are not real dollars.
8. Winners will be sent an email including a link to SkyMall and online gift certificate number to access the gift certificate.
9. The handle name of the contest winner will be displayed on the “Past Contest Winners” page for a period as determined by TVGfree.
Applicability of Contest Rules / Legality of Participation in the Contest
By participating in our contest, you acknowledge that your failure to comply with these Contest Rules may result in disqualification, forfeiture of prizes and/or legal action against you, as appropriate and as further specified in these Contest Rules. You may only participate in the contest if you are over 21 years of age (or such other minimum legal age in the jurisdiction where you are connecting) and it is legal for you to do so according to the laws that apply in the jurisdiction from where you are connecting. You understand and accept that TVGfree is unable to provide you with any legal advice or assurances and that it is your sole responsibility to ensure that at all times you comply with the laws that govern you and that you have the complete legal right to play the contest. Any participation in the contest is at your sole option, discretion and risk. By playing the contest, you acknowledge that you do not find the contest to be offensive, objectionable, unfair, or indecent in any way.
No purchase is necessary to participate in the contest, except for any cost you may incur to access the Site including costs charged by your Internet service provider or telecommunications provider. TVGfree reserves the right to suspend, modify, remove and/or add any contest in its sole discretion with immediate effect and without notice and TVGfree will not be liable for any such action.
By participating in the contest, you have the opportunity to receive email from ODS Technologies, L.P., the operator of the tvgfree.net website, about products and services offered by it or its affiliates. You may choose whether to receive such correspondence by checking the box on the “Enter Contest” page of the Site.
Employees of Sponsor and its agents, affiliates, subsidiaries, retailers, advertising & promotion agencies & immediate families (or persons residing in same household) of each are not eligible to win prizes.
Termination
You are entitled to withdraw from the contest at any time by sending an email or contacting us at the address below and we will respond within a reasonable time provided that you continue to assume responsibility for all activity under your handle name until such closure has been effected by us. TVGfree is entitled to terminate this agreement immediately on notice (or attempted notice) to you at the email address you have provided to us.
Limitation on Liability
IN NO EVENT SHALL TVGFREE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF TVGFREE.NET OR THE SERVICES, EVEN IF TVGFREE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR ACCESS TO THE SITE AND PARTICIPATION IN THE CONTEST IS AT YOUR SOLE OPTION, DISCRETION AND RISK. TVGFREE SHALL NOT BE LIABLE FOR COMPUTER MALFUNCTIONS OR ATTEMPTS BY YOU TO
PARTICIPATE IN THE CONTEST BY METHODS, MEANS OR WAYS NOT INTENDED BY THE TVGFREE.
Indemnity
You agree to indemnify and hold TVGfree, its subsidiaries, affiliates, officers, agents, and other partners, employees and service providers, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site or the services in violation of these Contest Rules and/or arising from a breach of these Contest Rules and/or any breach of your representations and warranties set forth above.
Results of Contest
You fully accept and agree that if there is a discrepancy between the contest result displayed on the Site and our server, the result showing on our server shall govern the result of the contest. Moreover, you understand and agree that (without prejudice to your other rights and remedies) our records shall be the final authority in determining the terms of your participation in the contest and any activity resulting from your participation.
Other
These Contest Rules are accepted upon your participation in the contest offered by TVGfree.net. The failure of TVGfree to exercise or enforce any right or provision of these Contest Rules shall not operate as a waiver of any such right or provision.
